What Is the Difference Between Splitting a Certificate and Separating a Certificate?

"Pecah sertifikat" (certificate splitting) is the process of dividing a single plot of land into several new certificates, typically carried out during inheritance distribution, partial land sale, or division of jointly-held rights. The characteristics of a certificate split include:

  • It originates from a single parent certificate as the basis for the split;
  • It results in several new certificates corresponding to the division of the land;
  • The plot of land is physically divided into separate parts; and
  • It requires re-measurement by the National Land Agency (BPN) to confirm the boundaries and area.

Meanwhile, "pisah sertifikat" (certificate separation) is the separation of the owner's name within a single certificate without dividing the plot of land. Its purpose is to create a new certificate corresponding to ownership, with the land area remaining the same. The characteristics of a certificate separation include:

  • The plot of land remains the same, without any change in area or shape;
  • Only the ownership or share of rights among the owners changes;
  • It commonly occurs for jointly-owned land where the owners wish to have separate certificates for each; and
  • It does not involve a physical division of the land, as it only separates the ownership rights.
